Terms of Service

By downloading, installing, accessing, or using the Prankix mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

These Terms constitute a legally binding agreement between you and Prankix ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the App after such modifications constitutes acceptance of the updated Terms.

You must be at least 13 years old to use Prankix. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and current

If you are under 18, you represent that you have obtained permission from your parent or legal guardian to use the App.

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use.

You agree not to:

• Modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's functionality or servers
• Attempt to gain unauthorized access to any systems or networks
• Use automated systems or bots to access the App
• Sell, rent, lease, or sublicense the App to third parties

The App allows you to create, submit, and share content, including drawings, text, and other materials ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content for the purpose of operating and improving the App.

You represent and warrant that your User Content:

• Does not infringe any third-party intellectual property rights
• Does not violate any applicable laws or regulations
• Does not contain harmful, offensive, or inappropriate material
• Does not contain personal information of others without consent

You agree not to submit User Content that:

• Is hateful, threatening, harassing, or discriminatory
• Contains explicit sexual content or nudity
• Promotes violence or illegal activities
• Contains spam, advertising, or promotional material
• Impersonates any person or entity

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

Prankix uses artificial intelligence to enhance gameplay experiences. By using the App, you acknowledge and agree that:

• AI-generated content and evaluations are automated and may not always be accurate
• AI processing may involve third-party services
• We do not guarantee the accuracy, reliability, or appropriateness of AI-generated content
• You use AI features at your own risk

We are not responsible for any decisions you make based on AI-generated content or evaluations within the App.

The App includes multiplayer and social features that allow you to interact with other users. When using these features, you agree to:

• Treat other users with respect and courtesy
• Not engage in harassment, bullying, or abusive behavior
• Not share personal information of yourself or others
• Not cheat, exploit bugs, or use unfair advantages
• Follow the spirit of fair play and good sportsmanship

We reserve the right to suspend or terminate accounts that violate these conduct standards.

The App and all its content, features, and functionality (excluding User Content) are owned by Prankix and are protected by copyright, trademark, and other intellectual property laws.

The Prankix name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Prankix. You may not use these marks without our prior written permission.

Certain features of the App may require payment or subscription. If you purchase a subscription or in-app purchase:

• All fees are in U.S. dollars unless otherwise stated
• Payments are processed through third-party payment providers (Apple App Store, Google Play Store)
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are subject to the policies of the applicable app store
• We reserve the right to change pricing with reasonable notice

We may suspend or terminate your account and access to the App at any time, with or without cause or notice, including if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your conduct harms other users or the App
• We are required to do so by law

You may terminate your account at any time by deleting the App and ceasing all use. Upon termination, your right to use the App will immediately cease, and we may delete your account and User Content.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the App will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of content

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Prankix and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last Updated" date
• Sending you an email notification (if you have provided your email address)
• Displaying a prominent notice within the App

Your continued use of the App after any changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App.

Entire Agreement: These Terms constitute the entire agreement between you and Prankix regarding the App and supersede all prior agreements.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
